The Madras high court ruled on Wednesday that suspension of a sentence is tantamount to suspension of the conviction.
The court was hearing a petition filed by former Tamil Nadu chief minister J Jayalalitha, seeking suspension of her conviction in the TANSI lead deal case and clearance to contest the forthcoming assembly election.
Dismissing the petition, Justice Malai Subramaniam, however, said it was for the Election Commission of India to decide on the All-India Anna Dravida Munnetra Kazhagam general secretary's eligibility to contest the election.
Jayalalitha had been sentenced to three years' rigorous imprisonment by the trial court for corruption in the TANSI land deal.
Another judge of the Madras high court suspended the sentence when she went in appeal against the trial court's verdict.
