A Delhi [Images] Court on Thursday deferred to July 10, the decision on Rahul Mahajan's application for permission to go to Mumbai.

Additional Sessions Judge S N Gupta reserved the order on Rahul's application after hearing heated arguments both from prosecution and defence sides. The court also released Sahil Zaroo's car after verification of its registration certificate issued in his father Ghulam [Images] Hassan Zaroo's name.

Rahul's counsel Ramesh Gupta told the court that he had no accommodation in Delhi other than the 7, Safdarjung Road, allotted to his late father as an parliamentarian, for which he will now have to pay up to Rs two lakh in rent per month if he did not vacate the same.

Gupta further argued that Rahul had always cooperated with the investigation and that his grandmother was ill for which he had to be present in Mumbai. Gupta also expressed Rahul's willingness to give an affidavit to the effect that he would vacate his late father's official residence within ten days.

The prosecution vehemently opposed the application on the ground that Rahul, if allowed to go to Mumbai, will tamper with the evidence available in Mumbai. It also contended that there had always been interference in the investigation from the accused person's side.

One of the bail conditions imposed on Rahul was that he would not leave Delhi until the chargesheet in this case was filed. However, he had moved an application on June 22 seeking permission to move to Mumbai, where he resides, as the New Delhi residence of his late father and BJP leader Pramod Mahajan was to be vacated by July 3.

On June 29, a city court had allowed Delhi police to conduct brain-mapping tests on Rahul Majahan and Sahil Zaroo, accused in a high-profile drug abuse case in New Delhi, giving the prosecution 'fair and proper opportunity' to investigate the matter.

According to the prosecution, laboratories at Ahmedabad [Images], Bangalore and Hyderabad were equipped to conduct the tests. Initially directing the police to fix any date after July ten for the tests, the court, however, extended the same to July 22.

The direction came after the defence counsel for both the accused filed applications seeking a stay on the order for a month as they intended to appeal against it before the high court.

Sahil and Rahul, along with the late Pramod Mahajan's key aide Vivek Moitra, had allegedly consumed an unspecified quantity of contraband on June one at the 7, Safdarjung Road residence, which, it is suspected, was supplied by three Nigerians who are presently in judicial custody.

While Moitra was later brought dead to Apollo Hospital, Rahul and Sahil had to be medically treated for their health condition. A case under Narcotic Drugs and Psychotropic Substances Act was subsequently registered with the Tughlak Road Police Station in New Delhi.
