The file pertaining to the recommendations made by the election commission in regard to disqualification of Miss Jaya Bachchan, member of Rajya Sabha from Samajwadi party, is now before the President of India A P J Abdul Kalam."The file reached the Rashtrapati Bhavan [Images] secretariat in the afternoon and the same has been put up before the President Kalam for is signatures," a senior official of the President House told rediff.com on Monday night.
When asked if a decision has been taken in this regard already, the source said, "Not as yet. It is now up to the President to decide," the source said.
According to constitutional experts President Kalam would have to abide by the recommendation of the election commission. Chief election commissioner B B Tandon had confirmed that the Commission had recommended the disqualification of Miss Jaya Bachchan from Rajya Sabha as she was holding an office of profit while she was a member of the Upper House.
Miss Jaya Bachchan is the chairperson of UP Film Development Board which is an office of profit according to the election commission and she had thus violated the article 102 (1) (a) bars a member of Parliament from holding any office of profit under the government of India or in any state other than an office declared by Parliament by law not to disqualify its holder.
President Kalam is leaving for a weeklong trip to Mauritius and Burma on March 8 and is expected to take a decision either late tonight or sometime on Tuesday.
